These Terms and Conditions (the “Terms”) are a legal agreement between you (including your heirs, executors, administrators, successors and assigns), and Tourette Association of America, a New York not-for-profit corporation, and its members, shareholders, directors, affiliates, officers, agents, and employees, Chapters, corporation, and its members, shareholders, directors, affiliates, officers, agents, and employees (“TAA,” “we,” “us,” or “our”). TAA and TAA’s chapters (“Chapter”) provide access to certain events (“TAA Event(s)”). These Terms apply to all participants at TAA Events (“Participant,” “you,” or “your”). You should read these Terms carefully before registering for a TAA Event. Your attendance at a TAA Event and/or your execution of any forms related to registration or participation in a TAA Event indicate your agreement to these Terms. By registering other Participants for a TAA Event, you indicate that you are able and have permission to agree to these terms on behalf of the Participant(s) you have registered and agree as follows:


You, on behalf of yourself and your heirs, executors, administrators, legal representatives, assignees, and successors in interest, do hereby fully and irrevocably release, discharge and covenant not to sue, the organizers and sponsors of the TAA Event, TAA, the Chapter, and TAA’s and the Chapter’s respective members, shareholders, directors, affiliates, officers, agents, and employees, and any other individual or entity working with TAA, and the Chapter in connection with the TAA Event (collectively, the “Releasees”), from any and all liability for any acts, omissions, occurrences, rights, causes of action, loss, liability, damage, or expense (including attorneys’ fees and expenses), whenever arising or discovered, and for any claim or demand on account of, or relating to, any injury to you (of whatever extent or nature) and any damage to your property, including injury, loss or damage (of whatever extent or nature) caused in whole or in part by the negligence of any Releasees or otherwise.


You further agree to indemnify, defend, and hold harmless the Releasees from any and all liability for acts, omissions or occurrences, rights, causes of actions, or claims for damages which may accrue to any individual or entity and may result, directly or indirectly, from your participation in or association with a TAA Event, or upon the premises where any TAA Event is being held. You further agree that you shall indemnify the Releasees for any damages awarded or expenses incurred as a result of any and all such liability for acts, omissions or occurrences, rights, causes of action, or claims for damages, including, but not limited to, attorney fees and court costs, and any expenses incurred by the Releasees in investigating, preparing or defending against any lawsuit, commenced or threatened, with respect to or arising out of the matters you agreed to in this Release.


You hereby grant the Releasees the power to consent to medical or dental treatment on your behalf.  You hereby release and forever discharge the Releasees from any claim whatsoever that arises, now or in the future, on account of any first aid, treatment or service rendered to you in connection with your participation in the TAA Event.


You understand the significant risks inherent in participating in any in-person TAA Event, and you understand that accidents, with fatalities, serious bodily injury and/or property damage can occur while participating in and/or engaging with any in-person TAA Event, as a result of negligence or otherwise. If the TAA Event involves physical activity, such as a race, walk, or bike ride, you agree not to enter or participate in the TAA Event unless you are medically able and properly trained. You agree to abide by any decision of an TAA Event official relative to your ability to safely participate in and complete the TAA Event. Relying upon your own judgment and ability, you agree to assume all risks of injury and loss (of whatever extent or nature) associated with participation in the TAA Event, including, but not limited to, falls, injuries sustained during training and/or during the TAA Event, contact with other participants, spectators or others, effect of the weather, including, but not limited to heat and/or humidity, traffic and the conditions of the course, all such risks being known and appreciated by you.


You understand that the Releasees do not carry or maintain health, medical, life or disability insurance coverage on your behalf. You are expected and encouraged to obtain your own medical, health, life and/or disability insurance coverage.


The TAA Event may include advice, opinions, and statements of various speakers, presenters, instructors, or other content providers (collectively the “Presenters”). TAA does not represent or endorse the reliability of any advice, opinion, statement, or any other information shared or provided by a Presenter or other TAA Event Participant. You agree and acknowledge that the views and opinions expressed at all TAA Events are those of the Presenters and Participants and do not reflect the views or positions of the TAA or Releasees. You further agree that your reliance upon any opinion, advice, statement, or any other information shared by a Presenter or other TAA Event Participant is at your own risk and you agree that the Releasees shall not be liable to you for your reliance on any of the advice, opinions, and statements of the Presenters or any TAA Event Participant.


You agree that the Releasees and any person or entity authorized by TAA or the Chapter, may photograph, audio tape, videotape and/or film you during the TAA Event and use such photographs, tapes and film in connection with TAA’s or the Chapter’s promotional, fund raising, or other publicity efforts and any other lawful purpose related to TAA or the Chapter without remuneration.

The Releasees use photographs, videos, and information relating to TAA Events and activities for educational, informational, promotional, charitable, and fundraising purposes, including, but not limited to TAA’s website, YouTube Channel and all other social media sites.

As a Participant, you grant unrestricted permission for you to be photographed, interviewed (if applicable), and otherwise recorded on audio and/or video or any media now existing or created in the future by TAA or an affiliated entity working with or authorized by TAA (“Authorized Entities”) and for such Authorized Entities to have unrestricted use of what has been recorded.

You agree that this permission to photograph, interview and record will remain in effect unless revoked by you at a later date in writing and delivered to TAA. Permission to use material obtained before revocation will survive in perpetuity if this consent is revoked.

In granting this permission, you understand that you have no control over how the recordings will be edited or how you will be portrayed. You hereby consent without limitation to the broadcast, publication, display, editing, online posting, or other lawful use of these recordings, which may include but not be limited to your name, image, likeness, silhouette, spoken words, student work, performance and movement, in any form (the “Works”), for any purpose, including without limitation, any news, informational, public relations, educational, professional development, fundraising, commercial, or promotional purpose, and in any media or through any communication channels, now existing or developed in the future.

You hereby waive any right to inspect or approve the Works now or in the future, whether that use is known or unknown to you, and you waive any right to royalties or other compensation arising from or related to the use of the Works.

You also understand that TAA, the Authorized Entities, and/or the respective media and other organizations shall own all rights, title, and interest, including the copyright(s), in and to the Works, to be used and disposed in perpetuity without limitation as these organizations shall determine in their sole discretion.

By entering into this informed consent and release and granting the permission as stated herein, you are also releasing TAA, the Authorized Entities, and their volunteers, employees, officers, directors, agents, representatives, subsidiaries, parent organizations, affiliates, licensees, and related entities from and against any and all liability, loss, damage, costs, claims (including but not limited to claims for the invasion of privacy, defamation, infringement, publicity, or other personal and/or property rights) and/or causes of action arising out of or related to your portrayal in Works and the display and use of such Works in any media.


You represent and warrant that you are over the age of eighteen (18), and you have the legal right to waive, release and discharge the claims, lawsuits and other liabilities as set forth herein for yourself and for those Participants you are registering, and to grant the consent to use your name, voice and likeness as well as the name, voice and likeness of the Participants you are registering as also set forth herein.




The names, trademarks, service marks and logos of TAA and its Chapters that appear at or in connection with a TAA Event may not be used in any advertising or publicity, or otherwise to indicate TAA’s sponsorship or endorsement of or affiliation with any product or service, without our prior express written permission.

TAA does not, in any respect, operate or control any information, products or services provided or presented by any third party at a TAA Event and TAA does not guarantee that any information contained thereon will be accurate. Third parties may participate in a TAA Event solely for the convenience of the Participants. Any third parties’ participation at a TAA Event does not constitute TAA’s endorsement, approval or certification of the third parties’ products, services, or information.


Participation in a TAA Event may require you to give us personal information including, but not limited to, your name, email, postal address, zip code, age, or other information. By attending a TAA Event or executing any forms relating to the registration or participation in a TAA Event, you agree to the TAA Privacy Policy (“Privacy Policy”), provided here. The Privacy Policy details the collection and use of the information that you provide to TAA in connection with your attendance at a TAA Event.


Unless otherwise noted, the following Refund Policy applies to all TAA
events with registration costs:  Full refunds will be provided to
individuals requesting a refund prior to 31 days in advance of an event.
Between 16 days and 31 days in advance of the event, only 50% of the
registration cost will be refunded. Between the day of the event and 15 days in
advance of the event, no registration costs will be refunded.
